Our Terms and Conditions, together with our Privacy Policy, form the basis of a legally binding contract between you and Bond Telegram Company Limited. In line with our ongoing policy of fair dealing and transparency, we have highlighted key points within our Terms and Conditions for your ease of reference and marked them as 'important'. To avoid any misunderstanding regarding the service we offer, what you can expect from us and what your obligations are, you are advised to read (and print out for your reference) these Terms and Conditions and our Privacy Policy prior to placing an order.

The contract provides protection to you and us that can be relied on under relevant circumstances and governs what happens if something goes wrong. It also shows we are serious about doing business the right way.

Terms and Conditions

Section I

1. Definitions used

  1. “We”, “us”, or “our” means BTC (Bond Telegram Company Limited) any affiliated companies or licensees.
  2. “You” or "your" means the message originator or sender of the Bond Telegram; the person or organisation that commissions us to create the Bond Telegram, together jointly with any third-person who may be identified as the sender or message originator of the Bond Telegram.
  3. "Our Web site" means www.bondtelegrams.com or any of our associated Web sites.
  4. “Bond” means the finished product we produce for you and at your request, as evidenced by you having placed an order.
  5. “Receiver” means the person(s) or organisation designated by you as the recipient of the "Bond".
  6. “Commission” means an order placed by you and accepted by us to produce the Bond Telegram and forward it to the receiver stipulated by you via our designated agent.
  7. "Agent" means national or international postal service(s), a carrier or courier service(s) or any other third party nominated by us to deliver the Bond Telegram.
  8. “Service” means the service provided by us as described herein.
  9. “Order” means your request for a service by us as identified on this page, whether completed or not.
  10. “Business day” means Monday to Friday inclusive, excluding holidays generally observed in the receiver’s country or locality.
  11. "Message originator" means you (or the person who has written or composed the message (words) that appear on the face of the Bond Telegram.

2. Formation of the contract

  1. IMPORTANT: When you place an order and we accept it, a legally binding contract is formed between you and BTC for the purchase of a Bond Telegram to be created by us for you and at your request for delivery to an address specified by you. The contract entered into upon receipt and acceptance of your order is by mutual assent and in consideration of the supply of said Bond Telegram in return for an agreed fee plus any additional associated charges such as delivery. The contract comes into force at the point your order is accepted by us, and is subject to our Terms and Conditions as stated herein.

    How the contract is formed between you and us.

  2. After placing an order via our Web site, you will receive an automated email from us acknowledging that we have received your order ('Acknowledgment'). This does not mean that your order has been accepted.
  3. Your order constitutes an offer by you to us to buy the Bond Telegram you have ordered. We will confirm acceptance of your order by sending you an 'Order Acceptance'.
  4. For the avoidance of doubt, 'Order Acceptance' will be sent to the email address you provided at the time of order.
  5. You understand that:
    1. your order represents a legal commitment to purchase the Bond Telegram you have ordered upon our acceptance of your order; and
    2. full payment (in consideration thereof) is payable at the point your order is accepted by us.
  6. When you place an order and we confirm it is accepted, it represents an unqualified 'offer' and 'acceptance' and a legally binding contract is formed between you and BTC at that point.
  7. By using the Service, you agree to comply with all of the Terms and Conditions set out in this document (the “Agreement”). We shall have the right at any time to change or modify the Service or the Terms and Conditions applicable to your use of the Service, or any part thereof, or to impose new conditions (including price changes) without notice.
    1. Our service allows you to send a Bond Telegram for delivery to an address specified in your order. The charges specified in our Web site represent a fee for the creation and delivery of the Bond Telegram by means of an agent. To the extent specified in this agreement, we will guarantee that such Bond Telegram is printed and delivered as addressed.
  8. IMPORTANT: Customs or handling charges that may be levied in the destination country are beyond our control and BTC are unable to accept any responsibility for these.
Section II

1. Placing your order

  1. IMPORTANT: If your order is for delivery outside the British mainland, you should contact us for delivery and handling charges before placing an order. A buyer requiring overseas delivery is responsible for paying all import duty, tax and fees which may be collected by the receiving country.
  2. On receipt of your order and successful payment you will be presented with a order success page.
  3. IMPORTANT: Message display. Your message will be displayed by us in a manner we determine will create the best visual presentation. Following formatting of your message, we will forward a proof of layout for your approval to the email address you gave us.
  4. Once a proof has been approved, any amendments to your order that require a new proof will incur a minimum charge of £10.00.
  5. You will be notified at various points throughout the process of your order status, but you can contact us at any time if you have concerns or enquiries on the status of your order.
  6. You will receive an email when we have dispatched your completed order - this will include a tracking number where applicable.

2. Secure payment processing

  1. We accept credit card payment.  If you are shopping from outside the UK your credit card company should convert the transaction to your own currency.
  2. We accept Visa and Mastercard for payment; all payments are via our nominated secure payment processor.
  3. IMPORTANT: You understand that the Bond Telegram you have ordered has to be individually created and in consideration thereof hereby authorise us to take payment at the point your order is accepted, prior to any work being undertaken by us. Prices shown are correct at the time of publication. Prices shown in GBP (£) are inclusive of VAT at the current rate, but excluding delivery unless otherwise stated. We reserve the right to change prices without notice.
  4. Orders are put forward only upon receipt of full payment. We aim to dispatch all orders within the time advised following receipt of full payment and your approved proof. BTC will endeavour to meet all delivery dates, barring unforeseen circumstances but offer no guarantee in this respect.
  5. You accept all charges outlined on the order summary page, and agree to pay the total amount pursuant to the cardholder agreement between you and your credit card issuer. In the event your transaction is declined, we are not obligated to store your order. You declare that you are the authorised cardholder of the account, or are otherwise expressly approved by the card issuer to make this purchase.
  6. Secure payment processing: BTC uses 128-bit SSL encryption technology to ensure that any information you transmit during the ordering process is secure. Our servers are secured to protect all personal information including your address and any products you may order. Our payment providers, Barclaycard (Barclays Bank PLC), are Level 1 PCI DSS compliant. BTC does NOT store credit or debit card information.

3. Postage and delivery

  1. Postage is not a cost that we can hide from, if we were able to absorb it, we would. The next best option is that we provide clear and transparent information on what the cost entails and why they are as they are.
  2. Packaging, securing contents, labeling and presentation all ensure that the Bond Telegram arrives with you or the person to whom you are sending it in a timely and undamaged condition. However, this does not come without cost and has to be included in charges.
  3. UK Mainland Postal Charges. All orders are sent for delivery via our designated agent. Orders can be tracked and followed from door to door. European and offshore orders are dealt with on a case by case basis and all costs are transparent as in all other transactions. If you need an item in a rush we are happy to help, but may levy an additional charge for priority ordering. Any additional postage charges will be clear and transparent.

    international customers

    1. Mainland Europe, Northern Ireland and Republic of Ireland. international postage cannot be automatically calculated within our current system. However, where a Bond Telegram is commissioned to be delivered internationally we send an electronic invoice for the international changes, once this has been completed the order will be dispatched as soon as possible.
    2. North America, Australia, Far East and Rest of the World. Please note that for all deliveries to the Rest of the World we need you to contact us for a quote on the cost of delivery. Orders placed without contact will result in you being required to pay the surcharge for additional costs associated with delivery.
    3. international orders for the windsor Bond Telegram or Royal windsor Special Edition Bond Telegram.
      Unfortunately, due to the prohibitive costs for the shipping of the above items to anywhere outside the UK mainland we CANNOT automatically accept orders for these items at present. However, we would be pleased to discuss the possibilities of overseas delivery should you wish to commission either a windsor or Royal windsor Bond Telegram for delivery anywhere outside mainland Britain.
  4. All deliveries are made by one of our designated agents who will require a signature on delivery and for this reason, it is not possible to deliver to a PO Box address.
  5. IMPORTANT: Delivery dates are provided as a general guideline. Weather, road conditions and other factors beyond our control can cause delays. However, if your Bond Telegram isn't delivered within a reasonable time, we'll make it right by offering to send a replacement. Excluded are Bond Telegrams that are refused, misaddressed (see below), or that violate a provision of these Terms and Conditions. It should be noted that we are not obligated to observe any instructions regarding delivery dates or times, nor do any such instructions modify our service or this agreement.
  6. Whilst every effort is made to ensure items are dispatched in a timely manner, ultimate delivery is subject to third party services such as our designated agent(s) over which we have no control. Therefore, delivery on a specific day or date cannot be guaranteed.
  7. IMPORTANT: For time-critical delivery it is important for you to leave sufficient time to enable the item to arrive safely and in a timely manner.
  8. We undertake to dispatch your Bond Telegram to the address you provide to us, for which a signature upon receipt from a responsible person over the age of 18 shall be required.
  9. IMPORTANT: You the sender are solely responsible for providing an accurate delivery address. If there is a mistake in the address, such as an incorrect street name or a missing postcode, your order might be delayed or even lost. Be sure you have given us a complete, correct address. Please note that we are not responsible for ensuring delivery to a specific individual at any address, regardless of any name entered as the recipient of the Bond Telegram on your order.
  10. In the case of hotels and other public places, Bond Telegrams are delivered to the front desk for further delivery by the facility's staff. You authorise anyone at the delivery location over the age of 18 to sign for and receive the Bond Telegram. You agree that if the destination address of the recipient, as submitted by you is incomplete, nonexistent, ambiguous, false, or does not conform to our designated agent's requirements, that the Bond Telegram is submitted at your own risk and that no refund or credit will be applicable if the Bond Telegram is misdirected, returned, or rejected by our agent.
  11. Bond Telegrams requiring assistance to look up or correct an address or postcode are subject to an address correction charge of £5.00.
  12. Our Web site may publish links to other companies’ Web sites that have address and telephone information for your convenience. We do not accept any responsibility for the accuracy or reliability of any information contained on external Web sites.

4. Cancellation clause

Terms Governing Order Cancellation

  1. An order is non cancelable expect under certain circumstances as detailed below:
    1. an order cancellation request must be given to us in writing and must be received prior to any creative or production work commencing and before any costs have been incurred on our part;
    2. for a cancellation request to take affect it must be acknowledged and confirmed by us in writing as accepted;
    3. acceptance of an order cancellation request is at our sole discretion and we are not obliged to accept a cancellation request that fails to meet our Terms Governing Order Cancellation herein shown above;
    4. in the event of order cancellation, we reserve the right to claim damages for breach of contract and to recover any loss we may have incurred arising from same;
  2. IMPORTANT: An order cancellation request that has not been made in writing or fails to comply with the above terms will not be considered.
  3. If you request that we stop the delivery of a Bond Telegram that you have commissioned, we may or may not be able to do so, and we are not obligated to do so. No refund or credit will be given for any Bond Telegram so cancelled or stopped.
  4. In the event a cancellation request is refused, an explanation for such refusal shall be provided and in such circumstances any money paid will not be refunded. You will be charged for any work already undertaken, if not already paid for, to the point of a cancellation request being acknowledged.
  5. IMPORTANT: Cancellation will incur the cost of all work completed to the date of an order cancellation request being received. This may include, but is not limited to, any work undertaken or materials used or purchased in relation to your order.

5. Non refundable

  1. Your Bond Telegram is a custom-made one of a kind personalised item, therefore, we are unable to offer refunds or exchanges. However, if we have made an error in fulfilling your order, we will offer to make right any such error. Any limitations placed upon you by us do not affect your statutory rights.

6. Returns

  1. Please note that you will be responsible for the costs of returning any item to us, unless otherwise agreed by us in writing. Items returned without our written approval may be refused.

7. Claims

  1. IMPORTANT: A claim of non-delivery must be made in writing, signed by you (or the sender if not you), and received at our office within fourteen (14) days of delivery notification.
  2. You authorise the disclosure of any information to third parties we may deem necessary for the purposes of substantiating your claim.
  3. For assistance with filing a claim for failed or non delivery, you can contact our help desk via the contact page.

8. Losses

  1. We will not be responsible for any loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss when using our Web site, service or when a contract for the sale of goods by us to you was formed.
Section III

General

1. Web site

  1. BTC maintains this Web site for your personal information. You may download on one computer or print one copy of the material on this web site for your own non-commercial, educational, private or domestic use only on the condition that you do not delete or alter any copyright, trademark or other proprietary notices.
    You should assume that everything you see or read on the Web site including images, photographs, illustrations, icons, texts, video clips, written and other materials (BTC material) is copyrighted and protected under treaty provisions and worldwide copyright laws, unless otherwise noted.
  2. We do not warrant that the functional aspects of our Web site will be error free or that this Web site or the server(s) that make it available are free of viruses or other possibly harmful elements. If your use of our Web site or BTC material results in the need for servicing or replacing property, material, equipment or data, BTC is not responsible for those costs. Without limitation to the foregoing, everything on our Web site is provided to you 'as is' and 'as available' without warranty of any kind, either expressed or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose or non-infringement. BTC and its suppliers make no warranties about the accuracy, reliability, completeness, or timeliness of BTC material, software text, graphics and links or about results to be obtained from using our Web site. Please note that some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
  3. When you post communications to our Web site via our blog, Web site comments fields, features comments, testimonials and product reviews, you automatically grant BTC a royalty-free, perpetual, irrevocable non-exclusive licence to use, reproduce, modify, publish, edit, translate, distribute, perform and display such communication(s) alone, or as part of other works in any form, media, or technology whether now known of hereafter developed and to sublicense such rights to anyone.
  4. Anything you transmit or post may be used by BTC for any purpose, including but not limited to reproduction, disclosure, transmission, publication, broadcast and posting, or developing, manufacturing and marketing products using such information.

2. Use of service

  1. While using the service you must comply with applicable laws at all times. You assume total responsibility and risk for your use of the service. You are responsible for paying all charges necessary to use and access the service, such as any computer hardware, software, and Internet access charges. We reserve the right to terminate the service to you for cause in the event that you breach our terms and conditions.
  2. We reserve the right not to provide the service where necessary facilities, materials or equipment are not available for any reason whatsoever. We make no guarantees as to the continuous availability of the service or of any specific feature(s) of the service.

3. Appropriate use policy

  1. You must not use the service to send anything that's harassing, obscene, threatening or illegal; or to send any unsolicited commercial message or chain letter; or to aid or assist any crime in any way; or to falsify, obscure, or impersonate someone else; or to provide any information which you know to be untrue; or to provide a false name(s) or address. You agree that if we cancel an order that violates the policy set forth in this section at our discretion, you will not be refunded.
  2. IMPORTANT: The 'Over-riding Principle' of a Bond Telegram is that a Bond Telegram MUST NOT be used for anything other than good - a Bond Telegram is designed to provide an exciting and 'pleasurable receiving experience' for the person receiving and is intended to be read, re-read, kept and treasured.
  3. If you believe, or have reason to believe, that the receiver would not welcome your message, than it would amount to a breach of the 'Over-riding Principle' of a Bond Telegram.
  4. Anything that could undermine our reputation or the 'Bond Telegram brand' would constitute a serious breach of the 'Over-riding Principle' and is, therefore, not permitted.
  5. We reserve the right to refuse an order if, in our opinion, our over-riding principle may be breached as a consequence of the Bond Telegram (message) content.

4. Alteration of service or amendments to the conditions

  1. We reserve the right to make changes to our Web site, policies, and these terms and conditions at any time. You will be subject to the terms and conditions in force at the time you place your order, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

5. Online/offline information

  1. We have made every effort to ensure that all information we give, either online or offline, is accurate. However, some information has been provided by our partners and suppliers and as such no guarantee is given or implied as to accuracy of information or suitability of a particular product. The onus is on you to make necessary checks prior to placing an order. We are always here and ready to answer any question you have.

6. Variations

  1. IMPORTANT: Although we make every effort to ensure photographs accurately represent the products to which they refer, it should be noted that not all computer screens are set the same and that operating systems may differ slightly in the way colour is displayed. Also, please note that as each product we create is an individual one-off piece and this includes a Bond’s presentation and packaging, there will inevitably be some difference in areas of colour, texture and patterning when comparing one item to another as each creation is unique.
  2. Measurements shown on our Web site are approximate to the nearest half centimetre or quarter inch.

7. Foreign languages and symbols

  1. Printing of your Bond Telegram (message) is restricted to the English alphabet, plus figures 0-9, and certain basic marks of punctuation.
  2. Other symbols or characters such as accented or foreign letters, or special characters to indicate tabulation, spacing or other formatting entered by you, may be substituted or omitted. We therefore recommend you use only letters A-Z, figures 0-9 and the punctuation marks full-stop, comma, hyphen and apostrophe. We reserve the right to amend or substitute symbols or characters as we deem necessary.

8. Errors and or omissions

  1. Should you encounter any errors or omissions within our Web site we would be grateful for you to draw same to our attention as soon as possible by using our contact page.

9. Events beyond our reasonable control

  1. We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.

10. Our environmental and social commitments

  1. We are committed to obtaining the best possible materials and producing our products in ways that are socially and environmentally responsible.

11. File records

  1. We maintain a record of each Bond Telegram created in the 'Book of Bonds' which is held in a secure location. Bond Telegrams are individually serial numbered and are unique, no actual copy is retained. Details held within the Book of Bonds are not made available to third parties except as required by law.

12. Business Transfers

  1. If BTC, or substantially all of its assets were acquired, or in the unlikely event that BTC goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of BTC may continue to use your personal information.

Legal Notices

1. General

  1. We accept no liability (to the fullest extent of the law) for the accuracy of information contained within our Web site or other relating media. These errors may be typographical or technical.

2. Exclusion of liabilities

  1. BTC does not guarantee the accuracy or completeness of any information provided on our Web site, and we will not be responsible for any errors or omissions, or for links embedded in messages. BTC will not be liable for any loss or damage caused by a visitor's reliance on information obtained from our Web site, or in a hyperlinked area of our Web site.

3. Right to amend terms

  1. We reserve the right to amend Terms without notice. Our ‘Terms’ and ‘Legal Notices’ sections should be read prior to any order placement or commitment on your part being made.

4. Disclaimer

  1. Product technical information and third party data has been obtained from the original manufacturers and suppliers and is offered in good faith in accordance with the company’s conditions to determine fitness for use. No guarantee is offered or implied. It is your responsibility to determine suitability for the purpose intended. In accordance with a policy of continuous improvement we reserve the right to amend products without notice.
  2. WALL FIXING: Caution should be exercised when drilling or hammering a nail into a wall as there may be sub-surface electrical wiring or pipe work that can cause damage or personal injury. If in any doubt regarding wall mounting of a Bond Telegram, then a suitably qualified person should be consulted prior to any drilling or hammering work being carried out.

5. Legal Statement

  1. All material on our Web site is the property of Bond Telegram Company Limited or its partners and suppliers and is subject to copyright. All trademarks, names, logos and other intellectual property is also owned by BTC or its partners and suppliers. Any modification, transmission, hiring, copying, reusing or otherwise using the content of our Web site for any purpose is strictly prohibited.

Whilst we endeavour to provide accurate and complete information, we will not be liable to any person or company for any loss or damage which may arise directly or indirectly from the use of our Web site (or any inability to use it) or any of the information contained on our Web site. Our Web site and the information and material which it contains are subject to change without notice. All warranties, whether expressed or implied as to the accuracy or completeness of the information contained on our Web site or in respect of any materials or products referred to on our Web site are hereby excluded to the extent permitted by law. BTC makes no representation as to the fitness of any product for any particular purpose.
  3. Links on our Web site may lead to other Web sites. The content, accuracy and function of such Web sites is put outside the control of BTC who accept no responsibility for the content, accuracy or function of such Web sites, nor does BTC endorse the contents of such sites unless expressly stated.
  4. You may choose to provide information to BTC about yourself or your company in the course of using our Web site. By doing so you expressly consent to BTC using this data. You also consent to BTC transferring the data to third party companies throughout the world for such purposes as order fulfillment and delivery. Any information you provide will not be sold to any third party. The information may also be used internally by BTC to assess the function of our Web site and the needs of our customers.
  5. Any communication or material which you transmit to BTC through our Web site or otherwise via the Internet will be treated as non-confidential unless expressly marked as such. Any communications and other material which you send to BTC is and shall remain the property of BTC and may be used for any purpose whatsoever, commercial or otherwise without compensation.

6. Terms governing Bond Telegram messages

All messages taken by BTC are subject to the following terms:

  1. IMPORTANT: To guard against mistakes or delays you should check all message content carefully, in particular you should ensure that the receiver's name has been entered correctly and that all necessary information required for proper postal delivery is full and accurate, prior to approving a message to be sent. Unless otherwise indicated on its face, the Bond Telegram is an original and paid for as such, in consideration whereof it is agreed between you and BTC as follows:
  2. BTC shall not be liable for damages, mistakes or delays in delivery, or for non-delivery, of any Bond Telegram received beyond the sum you have paid; nor for mistakes or delays in delivery, or for non-delivery; of any re-sent Bond Telegram beyond any sum paid for such re-sent Bond Telegram, unless specially valued; nor in any such case for delays arising from interruption in third party postal services howsoever caused.
  3. In any event BTC shall not be liable for mistakes or delays in delivery, or non-delivery, of any Bond Telegram whether caused by the negligence of its servants or otherwise, beyond the actual loss, not exceeding in any event the sum paid by you, at which amount you represent the Bond Telegram is valued, unless a greater value is stated in writing by you thereof at the time the Bond Telegram commission is accepted by BTC.
  4. BTC is hereby made your agent, without liability, to forward the Bond Telegram through a postal service (or a designated third party agent) necessary to reach its destination.
  5. Except as otherwise indicated the amount paid covers delivery to a recognised address. For delivery to an address outside the United Kingdom mainland responsibility for delivery will pass to a postal service provider within the country the Bond Telegram is to be delivered, with the understanding that you shall pre-pay all costs associated with such delivery.
  6. No responsibility attaches to BTC concerning Bond Telegrams until the same is confirmed in writing as accepted; when a Bond Telegram is sent for delivery to an agent acting for BTC, such agent acts for that purpose as your agent.
  7. BTC's tariff governing charges shall apply to all Bond Telegrams in each of such respective classes to all the foregoing terms.
  8. No employee of BTC is authorised to vary the foregoing.
  9. A Bond Telegram, of your own composition, is sent via BTC's designated agent (courier or postal service provider); accordingly it is understood and agreed by you that BTC shall provide to BTC's nominated agent information supplied by you to enable safe and accurate delivery of the Bond Telegram to the address as stipulated by you.
  10. Additional charges apply to Bond Telegrams requiring delivery outside the British mainland.
  11. BTC reserves the right to amend its Terms and Conditions without notice.

7. Additional limitations

  1. Without limiting the generality of the terms set forth above, Bond Telegram Company Limited:
    1. Hereby disclaim all express and implied guarantees as to accuracy of content, completeness or fitness of purpose of a Bond Telegram generally.
    2. Additional terms, conditions and limitations may apply as indicated on the transaction agreement made at the time of sale.

8. Trade marks and trading names

  1. Bond(s), Bond Telegram(s), Bond Telegram Message(s), Baby Bond Telegram(s), Wedding Bond Telegram(s), Anniversary Bond Telegram(s), Graduation Bond Telegram(s) and the Crown Logo are all trade marks or trading names of Bond Telegram Company Limited.   2. The trademarks, logos and service marks (collectively the "Trademarks") which you see on our Web site are registered and unregistered trademarks of BTC or are licensed to BTC by third parties. Nothing contained on our Web site should be construed as granting, by implication, estoppel, or otherwise, any licence or right to use any trademark displayed on our Web site without the written permission of BTC or such third party who owns the trademark. Your misuse of any trademark displayed on our Web site, or any other content on our Web site, except as provided herein, is strictly prohibited.

9. Copyright

  1.
